What these terms cover
These terms govern your use of the public XEX website at xex.to — the pages describing the platform, the programme directory, the pricing and start pages, and this legal set. They are between you and [[ To be supplied — XEX legal entity name ]] (“XEX”, “we”).
They are not the only terms in play, and they are the narrowest of the three you may be subject to:

- Governed by these terms.
- A workspace or operator console
- Governed by the Platform Terms agreed by the company that took the workspace.
- A member portal, and anything you buy in one
- Governed by the terms of the operator whose programme it is. XEX is not a party to those terms. See Complaints and Disputes if you disagree with something in one.
Using this website means you accept these terms. If you do not accept them, stop using the website.
What this website is not
This is the most important section of this document, and it is short on purpose.
XEX is software. Programmes listed here are operated by independent companies that set their own compensation plans, prices and terms. XEX does not operate a programme, does not endorse any programme, is not a party to any agreement between a programme and its members, and never holds member funds or private keys.
XEX does not offer an income opportunity. What anyone earns on a programme depends on real package sales in their team — not on recruiting, and not on time spent. Most people in programmes like this earn little or nothing. Nothing here is a guaranteed return, and no income is promised or implied.
It follows that nothing on this website is:
- an offer, solicitation or invitation to invest, or to acquire any security, financial instrument, crypto-asset or interest in any undertaking;
- an offer by XEX to sell anything a programme sells, or a recommendation that you join any programme;
- financial, investment, tax, accounting or legal advice, whether to a visitor, a member or an operator;
- a representation about what any programme pays, has paid, or will pay; or
- a statement that any programme, package or compensation plan is lawful, registered or licensed anywhere.
Figures that appear anywhere on this site in connection with a programme describe that programme’s rules. These figures describe the compensation plan. They are not a promise or projection of earnings. They describe what the rules pay when the conditions are met; they do not describe what any member has earned or will earn.
Programmes appear here when their operator publishes them. Listing is not vetting, not endorsement, and not a recommendation. Each operator is independently responsible for its programme.
Who may use this website
You may use this website only if all of the following are true.
- 01You are at least 18 years old, or the age of majority where you live if that is higher.
- 02You are not located in, ordinarily resident in, or accessing from, a country XEX does not serve. The list, and the reason for each entry, is in Prohibited Jurisdictions and Sanctions Policy.
- 03You are not a person, and do not act for a person, subject to applicable sanctions or export-control restrictions.
- 04You do not use a VPN, proxy, Tor exit, relocated SIM, borrowed address or any other means to conceal where you are or to obtain access you would otherwise be refused. Doing so is a breach of these terms and of the Acceptable Use Policy, whether or not it succeeds.
Programmes on XEX are not available everywhere. Availability depends on your country, on the programme's own rules, and on identity checks. Access may be refused or withdrawn where a programme is not permitted, and no refund of third-party costs follows from a refusal.
What you may and may not do here
We grant you a limited, non-exclusive, non-transferable, revocable right to view this website and to read and print its pages for your own information, including for the purpose of taking advice on them.
You may not:
- copy, republish, sell, licence or exploit the site or its content commercially, except where a page expressly permits it;
- frame or embed the site, or present its content as your own or as endorsing you;
- scrape, harvest or bulk-download the site or the programme directory, or use automated means beyond ordinary crawling that respects our robots directives;
- probe, load-test, interfere with or attempt to circumvent any access control, rate limit, geographic gate or authentication mechanism;
- use our name, marks, lockups or the visual identity of this site in a way that suggests XEX operates, endorses, guarantees or approves your programme, product or content; or
- remove, obscure, translate away or reproduce out of context any disclosure or disclaimer required by this legal set.
All intellectual property in this website, in the XEX name and marks, and in the platform itself remains ours or our licensors’. Nothing here transfers any of it.
Anything you send us
If you send us content — a message to a published contact address, a complaint, a security report, a programme description submitted for listing, or material supplied while taking a workspace — you confirm that you have the right to send it, that it is accurate, and that it does not infringe anyone’s rights or breach any law.
You grant us a non-exclusive, royalty-free right to use that content for the purpose you sent it for, and to retain it as a record where we are required or entitled to. We do not want and ask you not to send confidential information through a public contact route, and unsolicited ideas or proposals are not accepted in confidence.
A programme listing is written and published by its operator, not by us. We do not verify it, and publishing it is not a statement that it is accurate. Our rights to require changes to it, and to remove it, are set out in the Programme Marketing and Claims Policy and the Acceptable Use Policy.
Links, listings and third parties
This website links to programmes operated by other companies, to those companies’ own sites and terms, and to third-party services such as payment providers and identity-verification providers. Those destinations are not ours and we do not control them.
A link or a listing is not a recommendation, an endorsement, a warranty about the destination, or a statement that the destination is lawful, safe or accurate. Your dealings with an operator are between you and that operator, on that operator’s terms.
This programme is operated by the operator, not by XEX. Its packages, prices, compensation plan, payouts and support are the operator's responsibility. Read the operator's terms before joining. Joining is a commercial decision with no guaranteed outcome, and you may not recover what you spend.
Availability
We publish no availability commitment for this website or for the platform, and there is no service level agreement anywhere in this legal set. We do not operate a public status page and nothing in the product currently measures uptime, so a commitment would be unverifiable — by you, and by us.
The website may be unavailable, changed, restricted or withdrawn at any time, in whole or in part, without notice. Pages may be geographically restricted; see Prohibited Jurisdictions and Sanctions Policy.
No warranties
The website is provided “as is” and “as available”. To the fullest extent the law allows, we exclude all warranties, conditions and representations, whether express or implied, including any implied warranty of satisfactory quality, fitness for a particular purpose, accuracy, non-infringement, or that the site will be uninterrupted, timely, secure or error-free.
In particular we make no representation that any information about a programme — its packages, prices, compensation plan, payout terms or status — is accurate, current or complete. It is the operator’s information.
Limitation of liability
The cap, the carve-outs and the treatment of consumer and mandatory non-excludable liability all depend on the entity, the governing law and the markets addressed. The clause below is a drafting placeholder that states the intended shape only; it has not been settled, and no monetary cap is stated because none has been decided.
What is never excluded
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.
What is excluded
Subject to 9.1, we are not liable for loss of profit, revenue, business, opportunity, goodwill or anticipated saving, for loss or corruption of data, or for any indirect or consequential loss, arising from your use of this website.
Programme losses
Subject to 9.1, we are not liable for anything you spend on, lose through, or fail to receive from a programme operated by someone else. That includes the price of a package, amounts you expected to be paid under a compensation plan, and amounts an operator does not pay you. Your route in that case is the operator, and then Complaints and Disputes.
Cap
Subject to 9.1, our total liability in connection with this website is capped at [[ To be supplied — liability cap for website use ]].
Your indemnity to us
You will indemnify us against loss, liability, cost and expense arising from your breach of these terms, from your misuse of this website, from your attempt to circumvent an access control or geographic restriction, and from any claim brought by a third party in connection with content you sent us.
Governing law and where disputes are heard
Governing law and forum are unresolved and cannot be drafted around. They follow from the entity and from the consumer-protection rules of the markets where the site is read — which, given the locales this site publishes in, includes several with mandatory local forum rules for consumers.
